In a hotly disputed liability case, our client was killed after rear-ending a semi-truck in a daylight collision on an interstate highway in southern Indiana. Bill Winingham and Jon Noyes showed — with the help of experts in human factors engineering and accident reconstruction– that the semi-truck had a flat tire and was operating at such a slow speed that our client could not recognize the hazard it posed until it was too late. The case was filed in federal court and settled during private mediation after an unsuccessful federal settlement conference.
