Blog Additional $2.7 Million Judgment in Carbon Monoxide Injury Case

WKW attorneys Chris Stevenson and Kent Winingham obtained a $2.7 million judgment in the Eastern District of Tennessee Federal Court against Sublime Plumbing. The judgment was entered by Judge Travis McDonough on May 16, 2023.
WKW’s clients were five young women in their late teens and two moms who had rented a cabin in Gatlinburg, Tennessee in May 2021. The cabin was recently constructed in late 2020. The plumbing sub-contractor, Sublime Plumbing, incorrectly installed a tankless gas water heater at the cabin, failing to convert the water heater from natural gas to propane. The failure to make the conversion caused the water heater to produce excess carbon monoxide.
WKW’s clients suffered varying degrees of brain injury after being poisoned by carbon monoxide at the cabin. WKW brought claims against other defendants, including the property owner, the property management company, and an HVAC company that had been hired to fix the water heater. WKW entered into a confidential settlement against these defendants on behalf of its clients. The Sublime Plumbing defendants remained in the case and refused to engage in litigation. WKW submitted liability and damage evidence obtained through the course of discovery, including several expert reports relating to neuropsychological testing and SPECT brain imaging of the clients.
Judge McDonough authored a lengthy memorandum opinion under Case No. 3:21-cv-00311-TRM-DCP (ECF # 382) awarding a total of approximately $2.7 million against the Sublime Defendants.
