How Do I Initiate a Medical Malpractice Lawsuit?

The process that is used to initiate a malpractice claim or lawsuit in Indiana calls for the filing of a proposed complaint before the Indiana Department of Insurance. That is contrasted against what would typically be done in a normal negligence case in an intersection collision, where you would be entitled to go to the courthouse and start the legal proceedings by the filing of a complaint.

By starting the process with a proposed complaint, it begins the requirement of a case being presented to a medical review panel, which would be made up of three doctors or medical providers that would be in a position similar to that as the defending physician or hospital provider in each case.
