Product Liability Case Filed Against Biomet Orthopedics

On March 19, 2015, a man filed suit against Biomet Orthopedics, Inc. in the United States District Court for the Northern District of Indiana. The plaintiff asserts personal damages occurred after he received a metal-on-metal hip implant manufactured by Biomet.

Chromium and Cobalt Particles

In the suit, the plaintiff states that he received the Magnum Total Hip Arthroplasty System in 2007. The suit alleges that, subsequent to the 2007 surgery, friction and wear resulted in the release of chromium and cobalt into the man’s bloodstream.

Blood Tests Conducted

In September 2014, blood tests confirmed elevated levels of cobalt and chromium in the patient. Due to the results of the blood tests, the surgeon advised the patient that the hip implant system be removed. Revision surgery was then performed.

Allegations in the Suit

The suit claims that the defendant, Biomet, knew that the medical device could release metal debris into the body and/or bloodstream. Despite this, the suit alleges that Biomet marketed the Magnum metal-on-metal hip implant as one that was safer than—and superior to—other hip implant systems.

Specifically, the suit alleges that the defendant is guilty of negligence, breach of warranty, breach of implied warranties, and strict products liability. The plaintiff is seeking compensation for medical expenses as well as pain and suffering.
