Settlement vs. Trial

Bodily injury claims are either resolved outside of the courtroom or at trial. A settlement is an agreement between the victim and the negligent party or insurance company to pay compensation as negotiated. A trial, on the other hand, involves taking the claim to court.

Settlements are typically the quickest way to resolve personal injury lawsuits because when both parties agree to settle, they usually save time, effort, and money. Many personal injury cases end in a settlement agreement. Trials are expensive and taxing, and they often take much longer than settlement negotiations, but juries sometimes award more compensation to victims during a trial than the amounts offered during mediation.
