Jury Awards Half Million Dollar Settlement in Medical Malpractice CaseA Vienna, Va. man recently won a malpractice lawsuit he filed against the surgical team who performed his colonoscopy. The jury awarded $200,000 for malpractice, as well as $200,000 in punitive damages and $100,000 for defamation.

In this somewhat unusual case, the anesthesiologist and her team began mocking and insulting the patient as soon as he became unconscious. They also discussed ways to avoid the man after his procedure, and entered a false diagnosis into his chart.

The level of unprofessionalism the team displayed would be unbelievable if the patient had not inadvertently recorded the exchange on his smartphone. The patient had pressed record before the procedure to ensure he would remember the instructions his doctor gave him after the procedure.
