Man Suffers Fatal Injuries at Construction Site

Our client, a Michigan resident working as a subcontractor on a large construction project in northern Indiana, was pinned against a drainage trench sidewall when a heavy concrete manhole fell on him, leading to fatal injuries. Discovery showed that the foreman instructed our client to leave the trench prior to his injury. Despite this, Jon Noyes was able to prove that the general contractor owed a non-delegable duty to provide a safe work environment and was vicariously liable for the negligence of other contractors. The case was settled at mediation.
