    Through discovery, it was determined that the other driver was likely intoxicated at the time of the crash and further that he was working. Bill and Emily hired a vocational economist that was able to offer opinions about how the women had less career options and further that her work-life expectancy was reduced. They were also able to obtain a helpful report from the women’s treating surgeon about the effects this injury had on women’s life. Ultimately, the case was resolved on July 12, 2024, for $1.38 million.

    Bruce and Emily obtained $1.25 million settlement in a medical malpractice case on behalf of a baby who sustained a brain injury during birth when medical provider’s failed to timely deliver the child.

    Car Accident

    In May of 2023, a high school senior and volleyball player at Noblesville High School was traveling as a back seat passenger in a friend’s truck. While traveling, another vehicle negligently turned in front of the truck causing a collision. As a result of the crash, the young girl suffered a L2 transverse process fracture, T12- L1 epidural hemorrhage, and spinal cord injury. She then underwent surgery to have screws and rods placed into her back to repair it. Unfortunately, the young girl was recruited to play D1 volleyball at a nearby university, but because of her injuries she was not able to play her freshman year.
    Bill and Emily hired a physician to perform an IME to opine on the girl’s injuries and the effects it
    would have on the rest of her 70+ years of living.
    The case was resolved less than a year after the crash in early May of 2024, for $1.225 million with contributions from both the driver of the vehicle she was in, as well as the driver of the vehicle that turned in front.

    Kent and Emily obtained a $1 million dollar settlement in a medical malpractice case where the ER doctor failed to inform the patient of their possible kidney cancer.
    Due to the delay in diagnosis, patient ended up needing to have her kidney removed. Kent and Emily were able to get the case resolved before the presenting the case to a medical review panel due to a detailed demand outlining the clear malpractice.

    Motorcycle Accident

    A policy limits settlement of $1,000,000 was obtained within five months of an accident in which an Indianapolis businessman riding a motorcycle was struck in a roundabout by a driver working for a ridesharing company.
    The client suffered a significant femur fracture, was off work for an extended period of time, and went through in-home rehab. In the meantime, Wilson Kehoe Winingham Injury Lawyers got to work gathering dashcam footage of the collision and communicating with the insurance company immediately to let them know the severity of the injuries.     An intersectional collision in southern Indiana caused life-altering injuries to a nurse practitioner, eventually causing her to leave her well-paying job. With both liability and damages disputed, Bill and Emily used multiple experts including an accident reconstructionist, an independent medical examiner, and a vocational economist, to work up the case. The defendant was woefully underinsured, but owned dozens of tracts of valuable land. Wilson Kehoe Winingham Injury Lawyers investigated the value of those properties, also consulting with a collections law firm to assess the collectability of a judgment. After a second mediation and within weeks of trial, the case was settled for $875,000 with $725,000 of that amount coming from the individual defendant.

    In the summer of 2023, a 92-year-old woman was traveling from her home to visit her niece. While driving, an uninsured driver suddenly turned in front of her causing her to strike another vehicle and flip her car. As a result of the crash, she had a sternal fracture, compression fracture at T1, collapsed lung, and ended up needing a pacemaker put into her heart because of the trauma to the chest.
    Suit was filed in October of 2023 against the women’s car insurer. Following suit, Bill and Emily were able to acquire a report from the woman’s treating cardiologist who explained how the crash necessitated her need for a pacemaker.
    The case was settled at mediation on June 17, 2024, less than a year after the crash, for $775,000.

    Kent Winingham and Kayla Carmosino obtained a $750,000 recovery for the family of a milling company worker who was reversed into and over on a milling site and killed. Kent and Kayla were first able to prove through the client’s testimony that she while she was an adult, she was a dependent of the decedent.
    Thus, the recovery was not limited by the Adult Wrongful Death Statute.     Pedestrian Killed in Hit & Run

    In the early morning hours in southern Indiana, a man walking across a roadway in the dark was hit and killed by the driver of a vehicle. The driver then left the scene without calling for help and was later arrested for hit and run and for leaving the scene of a fatal accident. After being unable to settle with the driver’s insurance company, Wilson Kehoe Winingham Injury Lawyers attorney Bill Winingham filed a lawsuit for the benefit of the deceased man’s young daughter against the hit and run driver. The case was settled a short time later with the driver’s insurance company.

    Gas Can Explosion Seriously Burns Teenager

    A thirteen-year-old boy who was standing next to a camp fire while visiting a friend’s house suffered second and third degree burns over his arms, torso, and neck when another teenager picked up a plastic gas can and poured gasoline directly onto the open flames, causing the gas can to explode.
    The injuries were so severe that his body continued to burn for 72 hours after the incident, and he had to be put in a medically induced coma for 26 days. Doctors had to do relief cuts on his chest to relieve the pressure on his skin due to the swelling.
    The boy underwent extensive physical and occupational therapy while in the hospital and after he was released home. He was required to wear pressure garments 23 hours a day for over a year and a half to help reduce scar tissue buildup, and the mental and physical toll on the boy, who was in seventh grade at the time of the incident, continues to be significant.
    Wilson Kehoe Winingham Injury Lawyers clients originally brought suit against the homeowners, alleging a failure to maintain proper supervision over the minor children around the fire pit on her property, failure to maintain proper control and supervision of a dangerous condition, the fire pit, on her property, and failure to use reasonable care for the safety of guests on her property.
    The plaintiff also brought suit against the insurance company of the parents of the girl who poured gasoline on the fire. Both suits were settled before trial for a confidential sum.

    Steel Cable Trap Injures Child

    A farmer angry with motorcycle riders who traveled a path between a public road and his cornfields strung a steel cable across the path between two poles.
    Our vision experts later determined the cable was nearly invisible against the background of the path and fields. So when our 13-year-old client rode his dirt bike down the path, he never really had a chance to see what caught him mid-neck and severed his vocal cord nerves, esophagus, and trachea before it knocked him off of the bike.
    Although he survived the trap, the next two years of his life were filled with one medical emergency or procedure after another, in a constant fight to breathe, eat, and talk.
    The case was settled during mediation with the insurance adjuster for the property owner.

    Explosion at Fort Benjamin Harrison

    In an effort to track down a natural gas leak in a residential section of Army Ft. Benjamin Harrison in Indianapolis, an untrained army employee turned a pipeline isolation valve in the wrong direction, allowing gas to fill an abandoned steel pipeline.
    The gas leaked from the abandoned pipeline into a residential building, where it ignited and exploded, killing two and severely burning several others.
    We represented three of the burn victims and led a team of other plaintiff’s attorneys through the liability investigation of this explosion.
    We determined that not only had the valve been turned the wrong direction but also that the army lacked established guidelines for operating the gas system and had been working with inaccurate pipeline maps.
