What Is Summary Judgment?

Transcript

When a party tries to move for summary judgment, they’re trying to take the case out of the jury’s hands and allow the judge to make a ruling as a matter of law.

In doing so, the party tells the other side, “We’ll accept every material fact from your side of the story as true, but even if it’s true, you’re still not entitled to a remedy because there’s either no duty or there’s no recovery available for you as a matter of law.”
