Woman who suffered hand amputation settles case against machine manufacturers

WKW attorneys Bill Winingham and Chris Stevenson have settled a case for a woman whose hand was amputated after a machine component part broke in a machine accident in northern Indiana. The woman's hand was caught in the molding machine when a movable platform fell onto her hand after a steel cylinder rod broke. There was no safety mechanism in place to stop the heavy platform from falling onto her hand, crushing and burning it.

Investigation by the WKW attorneys revealed a prior similar failure known to the manufacturer of the machine, but there had been no change in the design or in the safety system of the machine to prevent future collapses. The case was settled for a confidential amount of money at mediation a few months before trial. The defendants were the cylinder rod manufacturer and the machine manufacturer. The claim included compensation for scarring and deformity, pain and suffering, medical bills, lost wages, and future impairment of earning capacity, as the woman is now disabled.
