WKW settles case involving maimed employee

WKW recently negotiated a settlement on behalf of a client who lost four fingers from his hand while operating a machine at his place of employment.  WKW filed a lawsuit on his behalf against the manufacturer, alleging it produced an industrial cutting machine that was unreasonably dangerous. The machine had a guard device that was readily disabled and it was mounted on non-locking wheels, which permitted the machine to move unexpectedly during operation. In addition, there was no "anti-repeat" safety feature, permitting the cutting mechanism to continue operation even when the user had no material in place to be cut.

While the client was using the machine, it moved away from him and as he reached to pull it back into position, his hand came into contact with the cutting mechanism. In a very unusual twist, the entire accident was captured on a security video. The manufacturer argued the video disclosed that the accident was the fault of carelessness on the part of the WKW client and improper workplace procedures on the part of his employer.  The case was settled prior to going to trial for a confidential sum.
