Just days before her third birthday, our client's daughter drowned in an apartment complex swimming pool surrounded by lifeguards and adult party goers. The management of the complex had very recently treated the pool in anticipation of the party. The pool was so cloudy by the time of the party witnesses reported being able to see only a few inches into it. Alcohol had been provided by the complex and witnesses considered the party loud and rowdy. Our clients were deaf and when the mother could not locate her daughter, she frantically tried to get a lifeguard to search the pool. The lifeguard ignored her. When a major search was undertaken, her daughter was not found in the water until ten minutes after the mother's initial request to the lifeguard. The little girl died from lack of oxygen to the brain.
