Failure to Recognize Degree of Injury

An active, energetic and curious four-year-old child found a pocketknife in his home. While running down the hallway, he tripped and fell on the opened blade of the knife and suffered a puncture wound to his left jaw. After an ambulance took him to the emergency room, the young boy's airway became compromised. When the ER doctor did not appreciate the gravity of the injury, the boy suffered grave hypoxic brain damage and subsequently died the next day. The Medical Review Panel was of the unanimous opinion that all defendants failed to meet the applicable standard of care and that this failure was a factor in the child's death. This matter was settled with the defendant doctor and hospital.
