Non-diagnosis of Bilateral Tumors

Our client had a history of neck and throat related complaints that were first evaluated by the Navy Medical Corps and later by his hometown physicians. His complaints continued as a 21-year-old student at a large university, and were evaluated by the university's health service. This evaluation included a CT scan that revealed bilateral neck masses and cervical adenopathy. Although these findings prompted a vascular surgery consultation with the defendant doctor, our client's neck masses remained uninvestigated and undiagnosed until an angiogram 15 months later showed bilateral paragangliomas, one of which had become metastatic. Our claim that the defendant doctor should have pursued a diagnosis of the clearly identified neck masses and that the 15-month delay in diagnosis and treatment caused serious harm to our client's health was upheld by a jury who found for the plaintiff and awarded compensatory damages.
